HOLLYWOOD - Anna Nicole Smith's former boyfriend Larry Birkhead is so certain he'll win the ongoing custody battle for the tragic model's baby daughter Dannielynn he's creating a nursery in his home.
The photographer was back in a Los Angeles courtroom yesterday asking a judge for a DNA test to determine the real father of the six-month-old tot.
In a private session, a judge refused to grant Birkhead's request that Smith's companion at the time of her death, Howard K. Stern, take a paternity test, but Superior Court Judge Robert Schnider said he would review the matter and scheduled a follow-up hearing for March 27.
Optimistic Birkhead, who insists he's Dannielynn's biological father, says the delay isn't dampening his spirit as he readies for what he feels is the inevitable.
He says, "I've been putting a nursery together, so I'm smiling. I'm in a good mood."
Meanwhile, at a press conference yesterday, attorneys in the paternity dispute between Birkhead and Stern confirmed there had been private talks about Dannielynn's future in the Bahamas, where Anna Nicole was laid to rest at the beginning of the month.
