Or we could just rely on the Straits Times' media hegemony..Originally posted by stellazio:interesting read.
but with so many grey areas, its hard for an individual to contest.
hopefully some lawyer who is also an anime fan will take this case up.
I think chances are too low if such a person exists. Plus it isn't going to be cheap.Originally posted by LazerLordz:I think it all depends on whether any accused is willing to go to trial with a legal team that is IT "MediaSentry case" and IP-savvy, and also knows a fair bit about the Japanese legal aspect of this case.

Just use Section 136 if possible and hope that no sections take precedence over this section. If somebody is going to argue about Section 38, it's very hard. Realistically, everything is possible.Originally posted by stellazio:interesting read.

Its kind of ridiculous that only local laws apply when the owners of the copyright are largely in Japan. Unless Odex can somehow claim to be the owners of the copyright by proxy in Singapore, or is the official sole distributor of particular animes in Singapore.Originally posted by ndmmxiaomayi:Yeah... but we have to see how the case goes. Currently, only local laws apply, so a lot of people are hurt right now.
If the case could go to Japan... we may see different results.
You have a point there, but as far as we are seeing, those that have been fined and paid up the fines have the local laws applied to them.Originally posted by Shotgun:Its kind of ridiculous that only local laws apply when the owners of the copyright are largely in Japan. IP laws is significantly different in application from eg. Criminal law. If I have no qualms about my intellectual property being distributed, I don't see why anyone else should be unhappy and decide to take legal action on MY Intellectual property that has been allowed to be freely distribute by the laws of my country of residence.
I hope the courts throw Odex's case out the window and fine that bugger for wasting everybody's time.
A thing which I wonder is Odex is only a distributor, not the copyright owner. Anime that we have gotten from a different 'source' other then them is deemed as infringement of 'their copyrights' ? A sole distributor has the right to market and sell their products... but it doesn't have the right to stop others from getting the products from elsewhere as there are no buying/selling/transactions done. They don't even say arigato????Originally posted by ndmmxiaomayi:Once he's done with his PC, I'll contact him. But unlikely he will stay around long enough for me to ask. They always disappear.
I wonder if that can be gotten by filing a information request through the Japanese side..Originally posted by Fingolfin_Noldor:Does anyone have details about the licensing? It would be interesting to study the terms of the license that ODEX has with regard to the anime they bring to Singapore.
good point!Originally posted by NekoRin:A thing which I wonder is Odex is only a distributor, not the copyright owner. It is like selling bottled mineral water and accusing others for getting their mineral water from the local streams.
Last thing, what's the copyright issue when we are not even ripping Odex's DVDs and put them up to download? The anime is courtesy from the fan-subs, not Odex.
this part seems weak.Originally posted by NekoRin:It is like selling bottled mineral water and accusing others for getting their mineral water from the local streams.

I was just wondering if it were possible to petition Tokyo TV to give us another distributor because seriously, ODEX is doing such a poor job marketing and distributing their products, I can hardly consider them even fit for the license.Originally posted by Master -_-:
then wats the use of buying?

my dad knows of this Japanese PR lawyer who's a friend of his partner who has specialised in IP issues in Japan. He noted a 40% chance of success only and the most is just an injuction
