Even if someone really manage to counter sue odex back and win the case. (very unlikely)
It proves nothing except that there are loopholes in how Odex is handling this matter.
Yes, glory and hounour might shine on whoever that wins the case. And people from the internet will look upon him as a hero.
But all in all. It will not help the anime community. Downloading will afterall still be illegal.
The government might even start to get paranoid about this online piracy case. And tighten up on online piracy laws.

The grievances that we all have is their sudden, without warning and damaging actions to catch those who are downloading.
I'm sure you are one of those who prefer to see a warning letter first before getting the letter to pay up for example.

They did warn the anime community numerous times before already.
You can go HWZ and dig up those news articles that they warned us on.
But people did not give in.
So they felt the need to do so.
And according to them. Its TV TOKYO that asked them to do so.
And from my point of view.
Even if they did warn the community lets say in May 2007.
The community would still continue to dl.
And even if odex catches what we downloaded from lets say june onwards.
The people in HWZ would still continue to bark.
